ORDER GRANTING EXPEDITED TREATMENT AND

OVERTURNING NORTH AMERICAN

NUMBERING PLAN ADMINISTRATOR’S DECISION

Issue Date: January 30, 2013                                Effective Date: January 30, 2013

On January 15, 2013, Southwestern Bell Telephone Company, d/b/a AT&T Missouri, filed an Application and Motion for Expedited Treatment requesting that the Missouri Public Service Commission review and reverse a decision of the North American Numbering Plan Administrator (NANPA), NeuStar, Inc., of AT&T Missouri’s application to obtain one thousands-block from which two hundred (200) consecutive numbers can be drawn within (1) the 573 NPA, (2) the Farmington rate center, and (3) the XXXX range of 5100-5299.  The additional numbers are needed in order to meet the needs of the St. Francois County Ambulance District, located in Farmington, Missouri.

On January 25, 2013, the Staff of the Commission filed its Staff Recommendation.  No other applications to intervene, requests for hearing, or recommendations have been filed.

Staff explained that AT&T Missouri does not have the numbers requested to meet this customer’s needs.  Staff believes AT&T Missouri has demonstrated a verifiable need for one thousands-block within the 573 NPA, an XXXX range from 5100 through 5299, in the Farmington, Missouri rate center. Staff recommended the Commission grant AT&T Missouri’s request.

The Commission has the authority to overturn NANPA’s decision to withhold numbering resources from a carrier pursuant to 47 C.F.R. §52.15(g)(4), which states in part, “The state commission also may overturn the NANPA’s decision to withhold numbering resources from the carrier based on its determination that the carrier has demonstrated a verifiable need for numbering resources and has exhausted all other available remedies.”

Based on AT&T Missouri’s application and the Staff’s recommendation, the Commission finds that AT&T Missouri has demonstrated a verifiable need for numbering resources and has exhausted all other available remedies.  The Commission will overturn NANPA’s decision and approve AT&T Missouri’s request for one block of one-thousand telephone numbers as listed above.

          THE COMMISSION ORDERS THAT:

          1.   Southwestern Bell Telephone Company, d/b/a AT&T Missouri’s Motion for Expedited Treatment is granted.

          2.  The North American Numbering Plan Administrator’s decision to withhold numbering resources from Southwestern Bell Telephone Company, d/b/a AT&T Missouri, is overturned.

          3.  Southwestern Bell Telephone Company, d/b/a AT&T Missouri’s request to receive one thousands-block within the 573 NPA, an XXXX range from 5100 through 5299, in the Farmington, Missouri rate center, is granted.

          4.  The Commission further determines that if a new code is required to be opened for this occasion, AT&T Missouri shall utilize one block of one thousand numbers and return the remaining nine blocks to the Pooling Administrator.

          5.  This order shall become effective on January 30, 2013.

          6.  This file may be closed on January 31, 2013.
