ORDER SUSPENDING TARIFF AND SETTING PREHEARING
CONFERENCE

On December 28, 2012, Summit Natural Gas (“Summit”) of Missouri, Inc., filed the above-referenced tariff. The tariff bears an effective date of January 29, 2013.
On January 18, 2013, the Office of the Public Counsel filed a Motion to Suspend and Request for Evidentiary Hearing. OPC states that the conversion program Summit proposes is prohibited by Commission rules. OPC further states that Summit must request a variance for such a program rather than simply file a tariff. Staff also objects, for similar reasons. Summit maintains the program is allowed by Commission rules.
There is not a sufficient record on which the Commission can decide to approve or reject the tariff. To allow sufficient time to study the effect of the proposed tariff and establish an evidentiary record, the proposed tariff will be suspended.
The Commission will suspend the tariff and schedule a prehearing conference to afford the parties the opportunity to discuss, define, and possibly resolve the issues presented. The Commission will also set a date for the filing of a proposed procedural schedule to ensure that this case progresses.
THE COMMISSION ORDERS THAT:
1. The proposed tariff sheet submitted on December 28, 2012, by Summit Natural Gas (“Summit”) of Missouri, Inc., and assigned Tariff No. JG‑2013‑0300, is suspended for a period of 60 days beyond January 29, 2013, to March 30, 2013, or until otherwise ordered by this Commission.
