ORDER DIRECTING STAFF TO REPLY

On December 21, 2012, the Staff of the Commission filed a recommendation and memorandum indicating Staff had reviewed the 2010-2011 Actual Cost Adjustment (ACA) filing of Atmos Energy Corporation. Staff did not propose any financial adjustments to Atmos’ ACA balances at this time, but offered non-financial recommendations regarding the company’s policies. The Commission directed Liberty Energy (Midstates) Corp. d/b/a Liberty Utilities, the successor in interest to Atmos, to respond to Staff’s recommendations and the company did so on January 28, 2013.

Before acting to resolve Atmos’ purchased gas adjustment filing, the Commission will direct Staff to indicate whether it is satisfied with Liberty Utilities’ response and whether it is now appropriate for the Commission to establish the final balances for Atmos’ 2010-2011 ACA.

THE COMMISSION ORDERS THAT:

1. The Commission’s Staff shall reply to Liberty Energy (Midstates) Corp. d/b/a Liberty Utilities’ Response to Staff Recommendation no later than February 28, 2013.

2. This order shall become effective upon issuance.
