On November 15, 2012, DIECA Communications, Inc. (“DIECA”) filed a letter with the Missouri Public Service Commission requesting that the Commission recognize its name change to MegaPath Corporation. However, DIECA did not include an adoption notice and revised tariff title sheet, a notice to its customers, or a statement that the company has reviewed and updated its contacts in EFIS, as required by Commission Rule 4 CSR 240-2.062(1). On November 15, 2012, the Commission issued an Order Directing Filing and Directing Staff to File a Recommendation, which required DIECA to amend its notice of name change to conform to the rule requirements. DIECA has failed to comply with the Commission’s order of November 15, 2012. The Commission will set a deadline for DIECA to amend its notice of name change.
THE COMMISSION ORDERS THAT:
1. DIECA Communications, Inc. shall amend its notice of name change to conform to the requirements of Commission Rule 4 CSR 240-2.062(1) no later than February 18, 2013.
2. This order shall become effective immediately upon issuance.
