ORDER OPENING A WORKING CASE TO ASSIST IN THE DRAFTING OF A RULE TO IMPLEMENT AN ENVIRONMENTAL COST ADJUSTMENT MECHANISM FOR THE WATER INDUSTRY

On November 9, 2012, Missouri-American Water Company filed a petition asking the Commission to promulgate a new rule to implement an environmental cost adjustment mechanism for water utilities.  In an order issued in File No. WX-2013-0267, the Commission has denied that petition, but has directed its Staff to prepare and present a proposed rule to the Commission by April 3, 2013.  The Commission has created this working file to facilitate Staff’s efforts to obtain input from interested stakeholders regarding the drafting of that rule. 

Staff intends to conduct two workshops to obtain stakeholder input regarding the drafting of the rule.  The initial workshop will be held on Thursday, January 24, 2013, from 10:00 a.m. to 4:00 p.m. at Room 316 of the Governor Office Building in Jefferson City.  A follow-up workshop will be held on Thursday, February 28, 2013, again from 10:00 a.m. to 4:00 p.m. at Room 316 of the Governor Office Building in Jefferson City.  The Commission invites all interested stakeholders to attend the workshops.

This file will serve as a repository for documents and comments.  Using this file, any person with an interest in this matter may view documents and may submit comments or documents.  As this is not a contested case, anyone may file a comment without legal counsel and without ex parte constraints.  Intervention requests are not necessary to submit comments or view documents.

THE COMMISSION ORDERS THAT:

1.       The Commission’s Staff shall host at least two workshop meetings to obtain input from interested stakeholders regarding the drafting of a new rule to implement an environmental cost adjustment mechanism for water utilities. 

2.               The initial workshop shall be held on Thursday, January 24, 2013, from 10:00 a.m. to 4:00 p.m. at Room 316 of the Governor Office Building in Jefferson City.  A follow-up workshop shall be held on Thursday, February 28, 2013, again from 10:00 a.m. to 4:00 p.m. at Room 316 of the Governor Office Building in Jefferson City. 

3.               The Commission’s Data Center shall provide a copy of this order to all Commission-certificated water utilities in the State of Missouri, and to all parties in Missouri-American Water Company’s most recent rate case, WR-2011-0337.

4.               This order shall become effective upon issuance.
