ORDER DIRECTING STAFF TO FILE RECOMMENDATION AND ESTABLISHING TIME TO RESPOND TO STAFF’S RECOMMENDATION

On December 27, 2012, Emerald Pointe Utility Company filed an application for authority to issue up to $1 million of secured indebtedness to finance a new sewer line and related improvements.  Emerald Pointe wishes to finalize the financing transaction on or before March 1, 2013, and asks the Commission to act on its application no later than February 18, 2013.   

The Commission will attempt to comply with Emerald Pointe’s request for expedited approval and to that end will order its Staff to file an expedited recommendation regarding Emerald Pointe’s application.     

THE COMMISSION ORDERS THAT:

1.               The Commission’s Staff shall file its recommendation regarding Emerald Pointe Utility Company’s Application no later than February 5, 2013.

2.               Any party wishing to respond to Staff’s recommendation regarding  Emerald Pointe Utility Company’s Application shall do so no later than February 11, 2013.

3.               This order shall become effective upon issuance.
