ORDER INCORPORATING DISPOSITION AGREEMENT AND APPROVING TARIFF

          The Missouri Public Service Commission is incorporating the:

·       Company/Staff Agreement Regarding Disposition of Small Water Company Revenue Increase Request (“agreement”); and

·       Schedules of rates and terms for water service (“tariff”) associated with the agreement.

Raytown Water Company (“the utility”) supplies water service to approximately 6,500 customers, most of which are residents of the City of Raytown, Jackson County, Missouri.

On June 4, 2012, the utility initiated this action. On November 1, 2012, Staff filed the agreement and notice of the agreement. On November 6, 2012, the utility filed the tariff with a proposed effective date of December 21, 2012.

The agreement provides for a full resolution of the utility’s request between Staff and the utility but does not include the Office of the Public Counsel (“OPC”). OPC filed its position statement on December 6, 2012, stating that it has no opposition to the agreement, and asks for neither a local public hearing nor an evidentiary hearing. No hearing is necessary to approve an application that no party opposes, [1] so the Commission will decide this action as a non‑contested case, and determine all issues without separately stating its findings of fact.

          The current and proposed tariffs bill two amounts monthly, a base customer charge and a usage rate, as follows.

The agreement also addresses recordkeeping and billing matters. Based on the Commission’s examination of the verified documents on file, the Commission independently finds and concludes that the agreement and tariff support safe and adequate service, at just and reasonable rates, and are in the public interest.

          Therefore, the Commission will approve the agreement and the tariff, direct the parties to comply with the agreement’s terms, and incorporate the agreement into this order.

THE COMMISSION ORDERS THAT:

1.     The Company/Staff Agreement Regarding Disposition of Small Water Company Revenue Increase Request (“agreement”) is approved. The agreement is incorporated into this decision as if fully set forth at length. All parties shall comply with the agreement.

2.     The tariff to which the Commission assigned Tracking No. YW‑2013-0225 is approved to become effective on December 21, 2012. The specific tariff sheets approved are:
