ORDER
CANCELING CERTIFICATE

This order cancels the private pay
telephone certificate of Weber Communications, LLC.
On November 9, 2012, the Staff of the
Missouri Public Service Commission filed a motion requesting Weber’s certificate
to provide private pay telephone service in the State of Missouri be
canceled.
In
Case Number PA-2004-0084, the Commission granted Weber a certificate of service
authority to provide private pay telephone service in the State of Missouri via
customer-owned coin-operated telephone equipment.
Staff’s motion states that the company
requested cancellation of its certificate of service authority. Staff recommends that the Commission cancel Weber’s
certificate of service authority as the company is no longer providing service
in Missouri.
On November 13, 2012, the Commission
issued an Order Directing Notice allowing any parties to file an objection or
request a hearing to do so no later than November 26, 2012. No objections or requests for a hearing were
filed.
The Commission has the authority to
cancel a certificate and tariff pursuant to Section 392.410.5, RSMo (Supp.
2010), which states, in part, “[a]ny certificate or service authority may be
altered or modified by the commission after notice and hearing, upon its own
motion or upon application of the person or company affected.”
Based
on Weber’s request and Staff’s motion, the Commission finds that the private
payphone certificate granted to Weber Communications, LLC, shall be canceled.
THE COMMISSION ORDERS THAT:
1. The private payphone certificate granted
to Weber Communications, LLC, in Case Number PA-2004-0084, is canceled.
2. This order shall become effective on December
10, 2012.
3. This
case may be closed on December 11, 2012.
