The Commission issued an order setting a prehearing conference to be held on November 22, 2012. Marcia Eason, Complainant, failed to appear. Commission rule 4 CSR 240.110(2)(B) states that unless good cause for failing to appear is shown, this complaint may be dismissed. Accordingly, the Commission will direct Complainant to file a statement showing good cause for failing to appear.
Further, Commission rule 4 CSR 240-2.116 (3) states that a party may be dismissed from a case for failing to comply with a Commission order. Hence, Complainant may be dismissed as a party to this case for failing to respond to this order.
THE COMMISSION ORDERS
THAT:
1. Marcia Eason, Complainant, shall file a statement as described in the body of this order no later than December 14, 2012.
2. This order shall become effective upon issuance.
