ORDER GRANTING MOTION FOR EXPEDITED
TREATMENT AND ORDER APPROVING TARIFF
IN COMPLIANCE WITH COMMISSION ORDER
Issue Date: October 31, 2012 Effective Date: November 2, 2012
On August 8, 2012[1], Liberty Energy (Midstates) Corp. d/b/a Liberty Utilities (hereafter “Liberty”) filed an application with the Missouri Public Service Commission under Sections 393.1009, 393.1012 and 393.1015, RSMo Cum. Supp. 2010, requesting that the Commission authorize the company to adjust its Infrastructure System Replacement Surcharge (hereafter “ISRS”) for numerous gas utility plant projects. On October 18, the Commission approved an ISRS for Liberty; however, the Commission rejected the tariff that Liberty filed, and allowed Liberty to instead file a tariff that comports with the Staff Recommendation filed on October 5.
On October 19, Liberty filed a tariff with an effective date of November 18. Liberty also filed a Motion for Expedited Treatment, asking for the new ISRS rates to go into effect on November 2 so as to coincide with its billing cycle. The Commission’s Staff filed its Memorandum on October 29, in which Staff stated that Liberty’s tariff complies with the Commission’s October 18 order.
Upon review of the pleadings, the Commission finds that Liberty’s tariff comports with the Commission’s October 18 order, and will therefore approve it. Further, the Commission finds that good cause exists for the tariff to become effective in less than thirty days; therefore, the Commission will approve the tariff to become effective November 2.
THE COMMISSION ORDERS THAT:
1. The following tariff filed on October 19, 2012, and assigned Tariff No. YG‑2013-0198, is approved to become effective on November 2, 2012:
P.S.C.
MO. No. 2
5th Revised Sheet NO.
19, Cancelling 4th Revised SHEET No. 19
2. This order shall become effective on November 2, 2012.
3. This case shall be closed on November 3, 2012.
