ORDER RESCHEDULING EVIDENTIARY HEARINGS

On January 31, 2012,[1] R. D. Sewer Co., L.L.C., Lakeland Heights Water Co., Inc., and Oakbrier Water Company, Inc., (“the companies”) initiated small company rate increase actions pursuant to Commission Rule 4 CSR 240-3.050.[2]  On August 28, the Staff of the Commission (hereafter “Staff”) and the companies filed Disposition Agreements that included comprehensive accounting schedules, a review of customer service and business operation and example tariffs designed to implement the agreed upon revenue requirements. 

The Office of the Public Counsel (hereafter “OPC”) did not join in the Agreements.  Instead, on October 4, OPC filed motions requesting the Commission to suspend the tariff and schedule local public hearings, which the Commission has granted.  Those hearings are set for October 29-30.

On October 11, the Staff of the Commission requested that the Commission schedule evidentiary hearings.  Staff does not necessarily believe that the cases will proceed to hearing.  But due to the December 31 decision deadline imposed by Commission rule, Staff wants the Commission to set a hearing date in case the parties are unable to resolve their differences.  At Staff’s request, the Commission set aside November 15 and 16 for hearings.

OPC asked the Commission to reconsider its decision.  After allowing Staff and OPC to respond, Staff suggested, and OPC accepted, two possible alternative schedules.  Thus, the Commission will reset the hearing

 

THE COMMISSION ORDERS THAT:

1.               The evidentiary hearings shall be held at the Governor Office Building, 200 Madison Street, Jefferson City, Missouri, Room 305, on November 21, beginning at 8:30 a.m.  These are facilities that meet the accessibility requirements of the Americans with Disabilities Act.  Any person who needs additional accommodation to participate in the hearings should call the Public Service Commission’s Hotline at 1‑800‑392‑4211 (voice) or Relay Missouri at 711 prior to the hearings.

2.               The following procedural schedule is established:
