On August 8, 2012[1], Liberty filed an application with the Missouri Public Service Commission under Sections 393.1009, 393.1012 and 393.1015, RSMo Cum. Supp. 2010, requesting that the Commission authorize the company to establish an Infrastructure System Replacement Surcharge for numerous gas utility plant projects. On October 18, the Commission rejected the tariffs Liberty filed with its August 8 application. But also on that same date, the Commission approved an ISRS incremental increase as agreed upon by Liberty and the Commission’s Staff.
On October 19, Liberty filed tariffs to implement the ISRS increase authorized by the Commission. Those tariffs bear an effective date of November 18. However, Liberty also filed a Motion for Expedited Treatment, stating that it wishes the new charges to become effective by November 2, which coincides with its billing cycle.
The Commission will order its Staff to file a Recommendation expeditiously or, in the alternative, a status report.
THE COMMISSION ORDERS THAT:
1. The Staff of the Commission shall file a pleading as ordered above no later than October 29, 2012.
2. This order shall become effective immediately on issuance.
