NOTICE OF DEFICIENCY
Issue Date: February 7, 2013
On
February 7, 2013, Tri-M Communications, Inc., d/b/a Globalinx filed an
application for registration to provide statewide interconnected voice over
Internet protocol service. Tri-M’s
application is signed by Leon Nowalsky, who is not identified as an attorney
licensed to practice law in Missouri.
Pursuant
to 4 CSR 240-2.080(2), pleadings filed with the Commission must be signed by at
least one attorney of record authorized to practice law in Missouri. Tri-M’s application is signed by Mr. Nowalsky,
who does identify himself as an attorney, however, fails to specify if he is licensed
to practice in Missouri and if so, failed to provide his Missouri bar number.
Tri-M’s
filing is deficient and the Commission will not take action on this application
until this deficiency is corrected. The
Commission will leave the file open
until February 28, 2013, to allow Tri-M to
correct the deficiency. If no response
is filed by that time, the Commission will reject the application and close the
file.
